1. Agreement to Terms

Clearpath Living Co., LLC may also be referred to in these Terms as “Clearpath.”

These Terms govern your access to and use of our website, services, applications, communications, and related offerings (collectively, the “Services”).

By accessing or using our website or Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Nature of Services

Clearpath provides professionally managed furnished residential housing solutions and partnership opportunities with property owners.

We may:

• Lease, sublease, or manage residential units
• Partner with third-party service providers
• Collect payments through third-party platforms

We do not guarantee availability, pricing accuracy, uninterrupted access, or financial results.

All rates, descriptions, and availability are subject to change without notice.

3. No Brokerage or Agency Relationship

Nothing on this website creates:

• A real estate brokerage relationship
• A property management agreement
• A landlord-tenant relationship
• A fiduciary duty

Any formal relationship will be governed by separate written agreements.

4. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Services.

By using the Services, you represent that:

• You have legal capacity
• All information you provide is accurate
• You will comply with applicable laws

5. Modifications to Terms

We may update these Terms at any time.

10. Limitation of Liability

To the fullest extent permitted by law, Clearpath Living Co., LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages.

Our total liability shall not exceed $100.

Some jurisdictions may not allow certain limitations.

11. Indemnification

You agree to indemnify and hold harmless Clearpath Living Co., LLC and its members, officers, employees, and affiliates from claims arising out of:

12. Governing Law

These Terms are governed by the laws of the State of Texas.

Any disputes not subject to arbitration shall be resolved in courts located in Texas.

13. Dispute Resolution and Binding Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms, the website, or the Services provided by Clearpath Living Co., LLC shall be resolved through binding arbitration rather than in court, except as otherwise provided below.

This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).

By agreeing to these Terms, you and Clearpath Living Co., LLC waive the right to a trial by jury and agree that disputes will be resolved exclusively through individual arbitration.

13.1 Informal Resolution First

Before initiating arbitration, both parties agree to attempt to resolve the dispute informally.

You must first send a written notice describing the dispute and the requested resolution to:

The parties agree to attempt good-faith negotiations for 30 days after the notice is received before initiating arbitration.

13.2 Arbitration Rules

If the dispute is not resolved informally, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect.

13.3 Arbitration Location

Unless otherwise agreed by the parties, arbitration shall take place in Texas, or may be conducted remotely via video or written submissions if permitted under AAA rules.

13.4 Individual Claims Only

You and Clearpath Living Co., LLC agree that any arbitration will be conducted on an individual basis only.

You waive any right to:

• participate in a class action
• participate in a class arbitration
• act as a representative in any class proceeding

The arbitrator may only award relief to the individual party bringing the claim.

13.5 Small Claims Court Exception

Either party may bring an individual claim in small claims court if the claim qualifies and remains within the jurisdictional limits of that court.

13.6 Arbitration Authority

The arbitrator shall have exclusive authority to resolve any dispute relating to:

• the interpretation of this arbitration clause
• the enforceability of this arbitration clause
• the scope of arbitration

The arbitrator may award the same remedies that would be available in court.

13.7 Confidentiality

All arbitration proceedings, including documents, testimony, and decisions, shall remain confidential unless disclosure is required by law or necessary to enforce an arbitration award.

13.8 Severability

If any portion of this arbitration provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

If the class action waiver is found to be unenforceable, the entire arbitration provision shall be void.

14. Termination

We may suspend or terminate access to the Services at any time if you violate these Terms.
